Kramer Levin partner Adam Rogoff and special counsel Anupama Yerramalli recently joined Debtwire legal analyst Richard Goldman to discuss the distressed state of US healthcare providers. During their conversation, the legal experts addressed the market and regulatory factors contributing to the healthcare industry’s current spate of distress; unique Bankruptcy Code provisions that govern healthcare and not-for-profit reorganizations; the legal, operating and regulatory considerations that healthcare providers must account for when conducting an asset sale; and developing case law concerning the Centers for Medicare and Medicaid Services’ ability to exclude healthcare providers from those programs, or terminate provider agreements, while in Chapter 11.
